Caps and limitsThree separate caps plus a zone limit. Per owner: no more than two short-term rental permits shall be issued to any owner, 5.50.040(A). Citywide: a total cap of three percent of total City housing units is placed on the number of short-term rental licenses issued, 5.50.040(B), which is a formula rather than a fixed number, so no permit cap figure is shown. Residential zones: short-term rentals in residential zones are capped at 19, 5.50.040(D). Zone limit: 5.50.040(A) also states that short-term rentals are allowed in C1 and C2 zones only, so the 19 in residential zones reads as a ceiling on existing or legacy residential permits rather than an open allotment. No lottery or waitlist language appears in the chapter.L15.50.040(A) · code text · checked 2026-09-13
Transfer when the home sellsThe permit does not run with the land and expires on transfer, but the buyer has a short, named path to a new one. MSMC 5.50.080 Changes in ownership states that permits issued for short-term rentals do not provide a vested interest in or entitlement to the continued operation of a short-term rental upon a change of ownership, and that short-term rental permits for short-term rentals shall not run with the land and shall expire upon any partial or complete transfer of ownership. The same section gives a new owner 30 days from purchase to file for a permit, failing which the property must cease short-term rental operation, and it gives the new owner a right of first refusal on a new permit. That 30 day window and the right of first refusal are the exceptions; there is no separate family, heir, spouse, trust or entity carve out. Note that any new permit is still subject to the two per owner limit in 5.50.040(A), the three percent citywide cap in 5.50.040(B), the C1 and C2 zone limit, and the residential zone cap of 19 in 5.50.040(D). Section 5.50.040 also provides that a property inactive or non compliant for six months faces revocation.L15.50.080 · code text · checked 2026-09-13
