Permit capPermits are capped at 800.L15.77.030.B.4 · code text · checked 2026-09-13
Caps and limitsCitywide cap of 800 dwelling units for non-primary residence short term rental registrations, LBMC 5.77.030.B.4, unless the City Council directs otherwise by ordinance or resolution. Within the coastal zone the maximum number of non-primary dwelling units registered as short term rentals is 350. Per operator: no more than one primary residence short term rental and no more than one non-primary residence short term rental. Per building, LBMC 5.77.030.B.3: buildings of 2 to 10 units, one short term rental; 11 to 50 units, 10 percent; 51 to 100 units, 12 percent; 101 or more units, 15 percent. LBMC 5.77.080 lets property owners petition to prohibit un-hosted short term rentals inside a census tract block group; a petition needs signatures of a majority of the property owners of residential real property within the boundaries, runs in an annual window of 180 days from January 1 to June 30, and a resulting restriction lasts a minimum of three years and then continues indefinitely unless removed by a later petition. The 90 nights is a night cap on un-hosted stays in a primary residence short term rental, not a permit cap.L15.77.030.B.4 · code text · checked 2026-09-13
Transfer when the home sellsThe registration may not be transferred or assigned and does not run with the land, LBMC 5.77.040.A. It is issued to the operator, is valid for an annual term and must be renewed. No family, heir, spouse, trust, entity or LLC exception, no transfer application window and no grace period appears in the chapter. A buyer of a registered property must apply for a new registration in the buyer's own name and will be subject to the caps that apply at that time, including the 800 unit citywide cap and the 350 unit coastal zone cap for non-primary residences. One related sale provision appears in the enforcement rules: after a revocation, no dwelling unit on that parcel may be registered for a minimum of twelve months.L15.77.040.A · code text · checked 2026-09-13
